Terms of Service
The rules for using SparkReel: your account, credits and plans, payments and refunds, and what you can do with what you make.
Last updated: October 18, 2026
1. The agreement
These Terms of Service ("Terms") are an agreement between you and SparkReel, a sole proprietorship operated by Anthony Gillion (sole proprietor), 719 W. 27th Street, Texarkana, Texas 75503, USA ("SparkReel", "we", "us"). They cover your use of our website, studio and related services (the "Service").
By creating an account, buying credits or using the Service you accept these Terms, our Privacy Policy and our Acceptable Use Policy. If you do not agree, do not use the Service.
If you use the Service for a company or other organisation, you confirm you have the authority to accept these Terms on its behalf.
2. Your account
You must be at least 18 years old, or the age of majority where you live, to create an account.
You sign in with a link sent to your email address. Keep access to that inbox secure: anyone who can open it can sign in as you, and you are responsible for everything done through your account.
One person, one account. Do not share your account, and do not create several accounts to collect free credits.
We may suspend or close accounts that break these Terms or our Acceptable Use Policy.
3. Credits, plans and payments
Generations are paid for with credits. The price of each run is shown before you start it. Prices are in US dollars, and sales tax or VAT, where it applies, is added at checkout.
Payments are processed by Stripe. For purchases made through our checkout, Stripe acts as the merchant of record: it calculates and collects applicable taxes, may run fraud checks, and its checkout terms apply alongside these Terms.
Subscription credits are granted each month and do not carry over to the next month. Annual plans are billed once a year and credits are granted monthly. Top-up credits do not expire while your account is open. Credits have no cash value and cannot be transferred or sold.
Credits for a run that fails, is blocked by a content filter or is canceled before it starts are returned to your balance automatically. This is the only automatic return of credits.
Subscriptions renew automatically at the price shown at checkout until you cancel. You can cancel at any time in your billing settings; your plan stays active until the end of the period you have already paid for. If you upgrade, the change takes effect immediately and you are charged the pro-rated difference; a downgrade or a shorter billing period takes effect at the end of the current period. We will give you notice before changing the price of a subscription.
4. No refunds
All purchases are final. We do not give refunds for subscriptions, annual plans, credit packs, unused or expired credits, or for results you are not happy with, except where the law requires otherwise. Nothing in these Terms limits any right you have under the consumer protection laws that apply to you.
Because Stripe is the merchant of record, Stripe may in some circumstances refund a payment under its own policies or where the law requires. If a purchase is refunded or disputed, we remove the credits it granted, and we may suspend the account if those credits have already been spent.
If you believe you were charged in error, write to support@sparkreel.online and we will look into it.
5. What you create
You keep your rights in the prompts and files you submit. You are responsible for them, including for having the right to use any reference images, video or audio you upload.
Subject to these Terms, your plan and the terms of the underlying model providers, you may use the images and videos you generate. Commercial use is included on paid plans; the free plan is for personal, non-commercial use.
Generated media can be similar for different users, may be inaccurate, and may not qualify for copyright protection in some places. We make no promise about who owns or can protect an output.
You give SparkReel a limited licence to store, process and display your prompts, files and generations as needed to run the Service for you. If you publish a generation to Community, you also allow other visitors to view it and to reuse its prompt and settings to make their own work. You can unpublish at any time.
6. Acceptable use
You agree to follow our Acceptable Use Policy. We may block, remove or unpublish content, and suspend or close accounts, that break it. Moderation decisions are ours to make.
7. The service and third parties
SparkReel relies on third-party AI models and infrastructure. Results vary, models change, and we may add, update, limit or retire models, features and prices at any time.
We work to keep the Service available but do not promise it will be uninterrupted, error-free or free of delays. Generations can take longer than expected or fail, for example when a model provider has an outage.
8. Our intellectual property
The SparkReel name, logo, website and software are ours or our licensors'. These Terms do not give you any right to them, other than to use the Service as intended. Do not copy, scrape, reverse engineer or resell the Service.
9. Copyright complaints
If you believe content on SparkReel infringes your copyright, write to support@sparkreel.online with the work you claim, where the content appears (a link), your contact details, a statement that you believe the use is not authorised, and a statement, under penalty of perjury, that your notice is accurate and that you are the owner or authorised to act for the owner. We may remove the content and close the accounts of repeat infringers.
10. Ending your account
You can stop using the Service at any time, and you can ask us to close your account by writing to support@sparkreel.online from your account address. Closing an account forfeits any remaining credits without a refund. We may suspend or end your access if you break these Terms, if the law requires it, or if we stop offering the Service.
11. Disclaimers
THE SERVICE AND ALL GENERATED CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY AND NON-INFRINGEMENT, TO THE FULLEST EXTENT THE LAW ALLOWS. AI output may be wrong, offensive or unsuitable; you are responsible for reviewing it before you rely on or share it.
12. Limit of liability
TO THE FULLEST EXTENT THE LAW ALLOWS, SPARKREEL WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA OR GOODWILL. OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE SERVICE IS LIMITED TO THE GREATER OF THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM AND US$100. Some places do not allow these limits, so they apply only as far as the law permits.
13. Your responsibility
You agree to cover the losses, claims and costs (including reasonable legal fees) that arise from your content, your use of generated media or your breach of these Terms or the Acceptable Use Policy.
14. Governing law and disputes
These Terms are governed by the laws of the State of Texas and applicable US federal law, without regard to conflict-of-law rules.
Before starting a claim, please write to support@sparkreel.online so we can try to resolve it informally. Any dispute that cannot be resolved that way must be brought in the state or federal courts located in Bowie County, Texas (including the US District Court for the Eastern District of Texas, Texarkana Division), and you and we agree to their jurisdiction. If you are a consumer, this does not remove any right you have under the mandatory law of the place where you live.
15. Changes and contact
We may update these Terms. If a change is material we will tell you by email or on the site before it takes effect. If you keep using the Service after the change takes effect, you accept the new Terms.
